Liability Waiver

DIY BAR, LLC (hereafter “DIY BAR”) is considered a private club.  Accordingly, your participation in the activities offered by DIY BAR is contingent on becoming a member of DIY BAR.  Your membership isfree and you can decide to terminate your membership at any time.  This membership is valid for 24 hours. This release survives the termination of your membership.

WAIVER AND RELEASE OF LIABILITY:

Terms of Membership

In consideration for DIY BAR, LLC (“DIY BAR”) agreeing to allow me to participate in its programs, events, classes or activities, I agree to the following: 

TO THE GREATEST EXTENT ALLOWED BY OREGON LAW, I HEREBY AGREE TO RELEASE AND DISCHARGE DIY BAR, ITS EMPLOYEES, INSTRUCTORS, MEMBERS, MANAGERS, VENDORS AND AGENTS FROM ANY AND ALL RESPONSIBILITY OR LIABILITY FOR ANY INJURY, DEATH, DAMAGE OR LOSS WHICH I MAY SUFFER RESULTING OR ARISING FROM MY PARTICIPATION IN ANY PROGRAM, EVENT, CLASS OR ACTIVITY OFFERED, CONDUCTED OR SPONSORED BY DIY BAR, REGARDLESS OF WHETHER OR NOT THE INJURY OR LOSS IS CAUSED BY ANY ACT, OMISSION OR NEGLIGENCE OF DIY BAR.  I FURTHER AGREE TO INDEMNIFY AND HOLD DIY BAR, ITS EMPLOYEES, INSTRUCTORS, MEMBERS, MANAGERS, VENDORS AND AGENTS HARMLESS FROM AND AGAINST ANY AND ALL LIABILITIES, LOSSES, DAMAGES, COSTS AND EXPENSES (INCLUDING ATTORNEYS’ FEES), SUITS, CLAIMS AND JUDGMENTS OF ANY KIND AND NATURE ARISING OUT OF, OR IN CONNECTION WITH ANY INJURY, LOSS OR DEATH THAT IS IN ANY WAY RELATED TO MY INVOLVEMENT WITH OR PARTICIPATION IN ANY PROGRAM, EVENT, CLASS OR ACTIVITY OFFERED CONDUCTED OR SPONSORED BY DIY BAR. ALL PROJECTS ARE SOLD AS IS. DIY BAR IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, ALL OF WHICH ARE EXCLUDED HEREBY.

I UNDERSTAND AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS INVALID OR UNENFORCEABLE, THE REMAINING PORTIONS OF IT REMAIN IN FULL FORCE AND EFFECT.

I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT. 

PHOTO RELEASE:

I understand that photographs and video images may be taken showing my participation in the programs, events, classes and activities offered by DIY BAR, and that DIY BAR or its agents, may publish or display on the Internet such photographs and video images for DIY BAR’s promotional purposes only.  By participating in DIY BAR events, I consent to the taking and publication of my photo or likeness for this purpose.  If you see staff with a camera and do not wish to be photographed, please let us know and we will honor you request.  If you see a photo of yourself, or a family member that causes you concern, please notify us.  As a courtesy, we will make every reasonable effort to dispose of the image and will not use it for future promotional purposes.
